By registering, accessing, or using our Service, you ("User") acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our Service.
1. Description of Service
smileShort is a Software-as-a-Service (SaaS) platform providing URL shortening, link analytics tracking, custom domain management, and related features according to the selected subscription plan.
2. Account Registration
- You must provide accurate, complete, and current account information during registration.
- You are fully responsible for maintaining the confidentiality of your password and for all activities that occur under your account.
- Users must be at least 18 years old or have legal consent from a parent/guardian to use this Service.
3. Subscription Plans and Payments
We provide Service based on flexible monthly or annual subscription options as follows:
- Standard Plan: IDR 99,900 / month (or IDR 990,000 / year — Pay for 10 months, get 1 year access)
- Pro/Enterprise Plan: IDR 249,000 / month (or IDR 2,500,000 / year — Pay for 10 months, get 1 year access)
Payment & Renewal Terms:
- Upfront Billing: Subscription fees are billed at the beginning of each billing cycle (monthly or annually).
- Automatic Renewal: Subscriptions automatically renew at the end of each billing cycle (monthly or annually) unless cancelled prior to the next renewal date.
- Refund Policy: All payments are non-refundable, except as explicitly required by applicable law or specific promotional terms.
- Price Changes: We reserve the right to modify subscription pricing at any time with at least 14 days' prior written notice.
4. Acceptable Use Policy (Prohibited Uses)
You are STRICTLY PROHIBITED from using our Service to shorten links pointing to:
- Malware, viruses, ransomware, phishing schemes, or malicious scripts.
- Fraudulent activities, illegal gambling, or unauthorized financial schemes.
- Pornographic content, child exploitation, or explicit adult material without proper consent.
- Hate speech, discrimination, harassment, defamation, or threats of violence.
- Intellectual property infringements (copyrights, trademarks, etc.).
- Spamming, unsolicited bulk email campaigns, or search engine manipulation.
Enforcement: We reserve the right to immediately disable links, suspend, or permanently terminate your account without refund if a violation of these terms is detected.
5. Service Availability & Warranties
- We strive to maintain a 99.9% service uptime. However, the Service is provided on an "AS IS" and "AS AVAILABLE" basis.
- We do not warrant that the Service will be uninterrupted, error-free, or that shortened links will remain permanently active if your account becomes inactive or violates terms.
6. Limitation of Liability
To the maximum extent permitted by applicable law, smileShort or its owners shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from:
- Your use or inability to use the Service.
- External third-party links created by other Users.
- Unauthorized access to or security breaches of our servers beyond our reasonable control.
Our total legal liability to you for any claim shall not exceed the total amount paid by you to Us in the past 1 (one) month (or the prorated monthly equivalent for annual subscriptions).
7. Cancellation and Termination
- You may cancel your subscription at any time via your account settings dashboard.
- Cancellation will take effect at the end of the current paid billing cycle (monthly or annual), and you will retain access to features until the end of that period.
- We reserve the right to terminate or freeze your access immediately for breach of these terms or illegal conduct.
8. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Indonesia. Any disputes arising shall be settled primarily through amicable negotiations or under the jurisdiction of courts in Denpasar - Indonesia.
